Terms of Service

Acceptance

By creating an account, using the app, placing an order, requesting a booking, posting content, purchasing a subscription, or otherwise using Foodtruckky, you agree to these Terms and to any additional policies shown in the app. If you do not agree, do not use Foodtruckky.

Eligibility

Foodtruckky is intended for users in the United States who are at least 17 years old. The service is not directed to children under 13. By using Foodtruckky, you represent that you can form a binding contract and that your use complies with applicable law.

Accounts

You may register as a consumer, vendor, or both where supported. You must provide accurate account information, keep your contact information current, and protect your login credentials and one-time passcodes. You are responsible for activity that occurs through your account.

We may refuse, suspend, restrict, or terminate accounts when we reasonably believe the account information is inaccurate, the account is compromised, the user has violated these Terms, or continued access may create risk for Foodtruckky, vendors, consumers, or others.

Account deletion is available in the app from Profile -> Delete account. Confirmed deletion cascades personal data associated with the account, subject to limited retention needed for legal, safety, fraud-prevention, accounting, dispute, and compliance purposes.

Vendor Responsibilities

Vendors are solely responsible for their menus, prices, availability, locations, order fulfillment, event services, food preparation, food safety, allergen disclosures, permits, licenses, insurance, taxes, and compliance with all health, safety, labor, consumer-protection, and tax laws that apply to their business.

Foodtruckky may provide profile fields, compliance reminders, document upload areas, ordering tools, booking tools, messaging, and payment facilitation, but Foodtruckky does not certify any vendor's compliance, inspect food, control vendor operations, or guarantee vendor performance.

Ordering and Payments

Consumers may place pickup food orders through participating vendors. Prices, menu availability, preparation times, pickup windows, taxes, and fees may vary by vendor and location and may change before an order is accepted.

Payment cards are processed by Stripe or its payment-processing partners. Foodtruckky does not store complete payment card numbers on its servers. By submitting payment information, you authorize the applicable charges for orders, booking deposits, fees, taxes, and any other amounts shown before checkout.

Vendors are responsible for fulfilling accepted pickup orders. If an order issue occurs, use the in-app support tools or contact support at customersupport@foodtruckky.com. Refunds, credits, or adjustments may be handled through the platform or vendor depending on the issue, applicable law, and payment-processing rules.

Event Bookings and Cancellations

Consumers may request vendors for private events. Vendors may accept, decline, message about, or quote event requests. Booking details, service terms, schedules, menus, minimums, deposits, remaining balances, and any special conditions should be reviewed before a booking is confirmed.

Foodtruckky charges a 10% platform commission on event bookings. The commission may be included in amounts charged or deducted from vendor payouts, depending on the booking flow shown in the app.

Unless a different written policy is shown for a specific booking or required by law, event deposits are refundable if the consumer cancels more than 24 hours before the scheduled event, minus the platform fee. Deposits are not refundable for cancellations within 24 hours of the scheduled event.

Foodtruckky is not responsible for weather, venue restrictions, permitting issues, utility access, parking access, customer attendance, vendor operational failures, or other circumstances outside Foodtruckky's reasonable control. The vendor and event organizer are responsible for confirming site requirements and event logistics.

User Content, Acceptable Use, and Moderation

Foodtruckky may allow users to submit reviews, ratings, photos, menus, vendor profiles, event details, booking messages, support messages, and other user-generated content. You retain ownership of content you submit, but you grant Foodtruckky a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, adapt, and use that content to operate, promote, improve, and protect the service.

You may not submit content or use Foodtruckky in a way that is unlawful, misleading, fraudulent, defamatory, harassing, hateful, sexually explicit, violent, invasive of privacy, infringing, spammy, malicious, or otherwise harmful. You may not impersonate others, scrape the service, interfere with platform security, manipulate reviews, evade suspensions, or use the app to arrange illegal activity.

We may review, remove, limit distribution of, or refuse to display content, and we may suspend or terminate accounts, when we believe content or conduct violates these Terms, creates safety or legal risk, or harms the integrity of the marketplace. Users can report content and block users through available in-app tools or by contacting customersupport@foodtruckky.com.

Subscriptions and Billing

Foodtruckky offers an optional vendor Premium subscription at $29.99 per month. The app shows the current price and included features before purchase.

The app store you purchased through bills the subscription to the store account used for purchase. It renews automatically unless canceled at least 24 hours before the end of the current period. The store account may be charged for renewal within 24 hours before the period ends. You can manage or cancel the subscription in the applicable store settings and use Restore Purchases in Foodtruckky to refresh your entitlement.

Subscription fees are generally non-refundable except where required by law or by the applicable app-store or payment-provider policy. If a subscription feature is unavailable because of account suspension, platform misuse, device limitations, or third-party service outages, your refund rights are governed by applicable law and the billing provider's rules.

Intellectual Property

Foodtruckky, including its app design, software, trademarks, logos, graphics, service names, and platform content other than user-generated content, is owned by Foodtruckky or its licensors and is protected by intellectual-property laws. You may use the service only as permitted by these Terms.

You must not copy, modify, reverse engineer, distribute, sell, lease, or create derivative works from any part of Foodtruckky except as allowed by law or with our written permission.

Disclaimers

Foodtruckky is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.

We do not guarantee vendor licensing, food quality, allergen practices, menu accuracy, order availability, delivery of event services, user identity, reviews, messages, or the conduct of any consumer, vendor, venue, or third party.

Limitation of Liability

To the fullest extent permitted by law, Foodtruckky and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost data, loss of goodwill, business interruption, food-related claims, event disruption, or third-party conduct.

To the fullest extent permitted by law, Foodtruckky's total liability for any claim arising from or relating to the service or these Terms will not exceed the greater of the amount you paid to Foodtruckky for the transaction or subscription giving rise to the claim during the three months before the claim arose, or $100.

Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law rules. Courts located in Delaware, USA will have exclusive jurisdiction for disputes that are not subject to an enforceable arbitration, small-claims, or app-store dispute process. This governing-law section is a placeholder and should be confirmed by Foodtruckky's legal counsel before launch.

Changes

We may update these Terms from time to time. When we make material changes, we may notify you in the app, by email, through the hosted Terms page, or by other reasonable means. Your continued use of Foodtruckky after updated Terms become effective means you accept the updated Terms.
